The Employment Non-Discrimination Act of 2013 (ENDA), S.815, is now scheduled to be voted on by the full Senate as early as Monday, Nov. 4. We anticipate that it will be a very close vote. Let your Senators know where we stand–take action via ADL’s webpage.
ENDA will expand existing federal employment discrimination coverage to include protection for those denied equal employment opportunities based on sexual orientation and gender identity. We are asking you to contact your Senators to urge that they support ENDA, without weakening amendment.
In 29 states it is still legal to fire employees because they are lesbian, gay, or bisexual – and 33 states lack explicit protections against discrimination on the basis of gender identity. ADL believes that employment decisions should be made based on merit, performance, and abilities – and never on the basis of an individual’s sexual orientation or gender identity.

In addition, here are some talking points that can be used in outreach to your Senators:
• Though 88% of Fortune 500 companies have workplace protections based on sexual orientation and 57% protect workers from discrimination based on their gender identity, thousands of hardworking LGBT Americans have lost their livelihoods simply because of who they are.
• According to a Center for American Progress poll, 73 percent of the American public supports protecting LGBT people from workplace discrimination. This support cuts across political party affiliation, with 81 percent of Democrats, 74 percent of independents, and 66 percent of Republicans supporting workplace nondiscrimination laws for LGBT people.
• ENDA contains a broad exemption for religious organizations and does not apply to any corporation, association, educational institution, or society that is exempt from the religious discrimination provisions of Title VII. Further, nothing in ENDA infringes on an individual’s ability to practice his or her faith or to exercise First Amendment rights of free speech on these or other issues.
